Snap is the owner of all copyright in and to the Ghost Design , as registered with the U.S. Copyright Office, U.S. Registration Number VA0002014816, dated 2016-08-25. See https://cocatalog.loc.gov/cgi-bin/Pwebrecon.cgi?Search_Arg=VA0002014816&Search_Code=REGS&PID=Dwd-sp0hkZ5HRfqjmuM6m96nox2KW&SEQ=20200131195414&CNT=25&HIST=1. An example of Snap’s use of the protected work is at https://www.snap.com/en-US/. In addition, Snap is the owner of the copyright in its Snapchat software, application programming interface (“API”) and technology (see https://www.snapchat.com/).

We recently learned that a website located at downloadmysnapchatmemories.com (the “Infringing Website”) for which you are the service provider on IP: [private], offers software downloadable on the Infringing Website that interacts with Snap API to allow users to log in to their Snapchat accounts and “download a copy of all memories [from a user’s Snapchat account] to [a] computer all at once.” To offer this service, the website operator has copied Snap’s copyrighted Ghost Design.

Snap requires account credentials to protect users and user data.
How is the accused project designed to circumvent your technological protection measures?
The user claims Snapchat users can log in to Snapchat accounts using the downloadable software giving the software unauthorized access to content within the Snapchat app.
