Notification on Copyright Violation – “iAnywhere Blue SDK”
Dear Ladies and Gentlemen,
We have read and understand GitHub’s Guide to Filing a DMCA Notice.
Referring to your DMCA Takedown policy, OpenSynergy GmbH (hereinafter “OpenSynergy”) reports a copyright violation by the GitHub users “secretnonempty” and “Sense1988”.
OpenSynergy has noticed that secretnonempty and Sense1988 use in their projects part of the source code of OpenSynergy‘s iAnywhere Blue SDK.
OpenSynergy’s protected business is software programming services, including software design, development etc. Blue SDK source code and its previous versions belong to OpenSynergy. The source code of Blue SDK, including the code labelled as iAnywhere Blue SDK in aforesaid GitHub profiles, has never been licensed by OpenSynergy to be publicly available.
Description/identification of the copyrighted work of OpenSynergy:
The material owned by OpenSynergy includes the version 2.1.1 of our Blue SDK Bluetooth protocol stack in the locations outlined below with various Bluetooth profile implementations and sub-components. It contains our intellectual property, namely the following software modules: “[private]” of which most of the files, including subdirectories are OpenSynergy´s code; specifically add-ins/at, [private]; “[private]” with most of its files, including subdirectories; “[private]” with most of the files; “[private]” with the file [private] OpenSynergy is the exclusive owner of the infringed software, which OpenSynergy acquired from iAnywhere Solutions, Inc.

OpenSynergy‘s product and information security experts were not able to get in touch with the owners. Please find hereunder the links to the alleged iAnywhere Blue SDK repositories:

Requested Action:
Please ask the users to remove all the instances of the source code above on GitHub and any other digital support/web resource the users may have published/made available/stored.
We have a good faith belief that use of the copyrighted materials described above on the infringing web pages is not authorized by the copyright owner, or its agent, or the law. We have taken fair use into consideration.
We swear, under penalty of perjury, that the information in this notification is accurate and that we are the copyright owner or are authorized to act on behalf of the owner, of an exclusive right that is allegedly infringed.
