Sky Deutschland Fernsehen GmbH & Co. KG and its affiliates Sky Switzerland S.A. and Sky Österreich Fernsehen GmbH (together “Sky”) are the owners or licensees of a number of films, broadcasts, sound recordings and other artistic, literary and dramatic works protected by copyright. The code(s), script(s) and/or decryption key(s) shared in these repository(ies) are designed to allow users to watch/access Sky broadcasts and/or VoDs by circumventing Sky’s broadcasting encryption technology without purchasing a legitimate subscription directly from Sky.
The user(s) in question is/are not authorised to distribute or otherwise provide access to Sky content and is/are therefore infringing Sky’s copyright in a number of ways, including, but not limited to: (1) by assisting to a copyright infringement according to Section 87 para 1 subpara 1 UrhG (German Copyright Code), Section 27 StGB (German Criminal Code) AND (2) by circumventing Sky’s broadcasting encryption technology and/or offering for sale products that are designed to circumvent that technology (section 95a para 3 UrhG).
Sky broadcast channels (including, but not limited to, Sky Sport Bundesliga 1-10, Sky Sport 1-11, Sky Cinema, Sky Atlantic, Sky Krimi) contain audio-visual works, in which the content includes live coverage of current and sporting events as well as news, sports and entertainment programmes.
