Sky is the owner or exclusive licensee of a number of films, broadcasts, sound recordings and other artistic, literary, and dramatic works protected by copyright. The code(s), script(s) and/or decryption key(s) shared in these repository(ies) are designed to allow users to watch/access Sky broadcasts by circumventing Sky’s broadcasting encryption technology without purchasing a legitimate subscription directly from Sky. The user(s) in question is/are not authorised to distribute or otherwise provide access to Sky content and is/are therefore infringing Sky’s copyright in a number of ways, including, but not limited to: (1) by authorising copyright infringement (section 16(2) of the UK Copyright, Designs and Patents Act 1988 (CDPA 1988)); AND (2) by circumventing Sky’s broadcasting encryption technology (sections296ZA and 296ZD, CDPA 1988).
Sky broadcast channels (including, but not limited to, Sky News, Sky Sports, Sky Max, Sky Witness) contain audio visual works, in which the content includes live coverage of current and sporting events as well as news, sports and entertainment programmes.
