Spotify is a leading global streaming subscription service that provides users access to content from artists and podcasters all over the world. Spotify users access this content through several platforms, including the Spotify desktop app on PC and Mac and Spotify’s mobile applications. Spotify owns copyrights in its desktop and mobile application software (“Spotify Copyrights”). Spotify’s desktop and mobile application software can be downloaded at the following link: https://www.spotify.com/us/download/other/. The files identified below were derived from unauthorized copies of the Spotify Copyrights and/or the files identified below are derivative works based on the Spotify Copyrights.

Spotify employs technological measures that control how users access the copyrighted content hosted on Spotify. These measures include, but are not limited to, encryption and designing a protocol for the use of transfer keys that is complex and difficult to decipher.
**How is the accused project designed to circumvent your technological protection measures?**
Spotify does not contend that the accused files are designed to circumvent Spotify’s technological measures under 17 U.S.C. 1201(a)(2). Spotify instead contends that the files identified above are made via unauthorized copying of Spotify’s Copyrights and/or are unauthorized derivative works of Spotify’s Copyrights, and directly infringe Spotify’s Copyrights.
