While GitHub did not find sufficient information to determine a valid anti-circumvention claim, we determined that this takedown notice contains other valid copyright claim(s).
---
**Are you the copyright holder or authorized to act on the copyright owner's behalf?**
Yes, I am the copyright holder.
**Are you submitting a revised DMCA notice after GitHub Trust & Safety requested you make changes to your original notice?**
No
**Does your claim involve content on GitHub or npm.js?**
GitHub
**Please describe the nature of your copyright ownership or authorization to act on the owner's behalf.**
I have read and understand GitHub's Guide to Filing a DMCA Notice.
I am the [private] of record for [private], an introductory CS course at [private], Northeastern University taught using Python. [private] and organize all aspects of coding assignments, starter code, and solution code for the sections of the course [private].
**Please provide a detailed description of the original copyrighted work that has allegedly been infringed. If possible, include a URL to where it is posted online.**
The contents of the following repository are entirely duplicated from material provided in [private] NEU course, specifically assignments, labs, starter code, and solution material:
https://github.com/learnerInTheFirstStage/CS5001_Python_learning
The [private] listed in the readme, [private], was a student of [private] in this course (I do not know if this person is the owner of the repository, and our university's administration and faculty have so far been unable to reach him directly).
The URL to the original material is not public. The material resides in the Canvas LMS course environment and is only available to students enrolled in the course.
Students in [private] course sign an academic integrity pledge and are informed clearly in person and in the syllabus that the material in the course is not to be published or distributed.
**What files should be taken down? Please provide URLs for each file, or if the entire repository, the repositorys URL.**
The following repository and all its contents are infringing on my copyright:
https://github.com/learnerInTheFirstStage/CS5001_Python_learning
**Do you claim to have any technological measures in place to control access to your copyrighted content? Please see our <a href="https://docs.github.com/articles/guide-to-submitting-a-dmca-takedown-notice#complaints-about-anti-circumvention-technology">Complaints about Anti-Circumvention Technology</a> if you are unsure.**
Yes
**What technological measures do you have in place and how do they effectively control access to your copyrighted material?**
The material is only available to students enrolled in [private] course through the Canvas LMS environment. Students in [private] class are required to sign an academic integrity pledge acknowledging among other things that none of the material is permissible to distribute or publish.
**How is the accused project designed to circumvent your technological protection measures?**
It appears that the owner of the GitHub repository was a legitimately enrolled student who broke the academic integrity pledge and published material that he was entitled to access but not entitled to publish.
**<a href="https://docs.github.com/articles/dmca-takedown-policy#b-what-about-forks-or-whats-a-fork">Have you searched for any forks</a> of the allegedly infringing files or repositories? Each fork is a distinct repository and must be identified separately if you believe it is infringing and wish to have it taken down.**
There do not appear to be any forks associated with this repository, although I don't think I am able to know whether and how often the repository has been cloned, which is a reason that I would like it removed as soon as possible.
**Is the work licensed under an open source license?**
No
**What would be the best solution for the alleged infringement?**
Reported content must be removed
**Do you have the alleged infringers contact information? If so, please provide it.**
