The files identified by HashiCorp were created from files originally published under the Mozilla Public License, Version 2.0 (“MPL-2.0”). HashiCorp may not like that a fork of these files was created, but the MPL-2.0 provides all the rights necessary to make copies of the MPL-2.0 licensed source code into new MPL-2.0 files. We have provided a public and full analysis of the origin and use of the MPL-2.0 licensed source code to create these files and have published all this information here: https://opentofu.org/blog/our-response-to-hashicorps-cease-and-desist.
